Work Permit Thailand: Requirements and Process for Foreign Employees

A work permit in Thailand isn’t tied to a visa the way many foreigners assume — it’s a separate authorization tied to a specific employer, a specific role, and specific work location. Change any of those three and, technically, the existing permit no longer covers you. This distinction is where a lot of otherwise-compliant foreign employees end up in violation without realizing it.

Who Actually Needs One

Any foreigner performing work within Thailand’s borders needs a work permit before starting, regardless of how the work is structured. This explicitly includes:

  • Foreign employees of Thai or international companies operating in Thailand
  • Company directors and shareholders who perform active operational duties (not purely passive investors)
  • Entrepreneurs establishing and running their own Thai businesses

“Work” is defined broadly under Thai law — it isn’t limited to paid employment in the conventional sense, and unpaid or volunteer activity that constitutes engaging in an occupation can still require a permit. Foreigners frequently misjudge this, assuming that because they’re not drawing a Thai salary, or because the work is remote and for an overseas client, no permit is required. The safer assumption is that any active work activity conducted while physically in Thailand needs review, not that it’s automatically exempt.

The Sponsoring Company’s Obligations

A work permit isn’t something an individual applies for independently — it requires a Thai-registered company (or in some structures, a BOI-promoted entity) to sponsor the application, and that company takes on specific compliance obligations in doing so:

  • Minimum paid-up capital: THB 2 million per foreign employee for Thai-majority-owned companies, rising to THB 3 million per foreign employee for foreign-majority-owned companies
  • The 4:1 ratio: sponsoring companies must generally maintain at least four Thai employees for every one foreign work permit holder
  • Ongoing compliance: 90-day reporting, re-entry permit management, and address notification obligations continue for as long as the foreign employee holds the permit

These aren’t one-time boxes to check at application — the ratio and capital requirements are maintained obligations. A company that sponsors a work permit and later reduces its Thai headcount below the 4:1 threshold creates a compliance problem that can affect the foreign employee’s permit status, not just the company.

Exceptions Worth Knowing

BOI-promoted companies benefit from significantly faster processing — in some cases under six hours for work permit issuance — and relief from certain standard ratio and capital requirements, reflecting the government’s interest in accelerating hiring for promoted-sector investment.

LTR visa holders have a more nuanced position. Work-from-Thailand Professionals performing work exclusively for an overseas employer do not require a traditional Thai work permit at all. Other LTR categories — including Wealthy Global Citizens and Wealthy Pensioners who want to undertake work activity in Thailand — may still need a digital work permit, which is a streamlined version of the standard process but not a full exemption. Highly Skilled Professionals under the LTR program are required to hold a digital work permit as a mandatory condition of that category.

The Application Process

  1. Underlying visa first. A work permit application requires the foreign employee to already hold, or be in the process of obtaining, an appropriate Non-Immigrant B (business) visa or equivalent — the work permit doesn’t substitute for immigration status, it sits alongside it.
  2. Company documentation. The sponsoring company submits its registration documents, financial statements demonstrating the capital requirement, and evidence of its Thai employee headcount to satisfy the 4:1 ratio.
  3. Position justification. Many applications require the company to explain why the role needs to be filled by a foreign national specifically — particularly relevant for roles that could plausibly be filled by a Thai employee.
  4. Submission and processing. Standard processing timelines vary by Ministry of Labour office and case complexity; BOI-promoted applications move considerably faster than standard filings.
  5. Ongoing renewal. Work permits are typically tied to the underlying visa’s validity period and require renewal alongside it — letting either lapse independently creates a compliance gap even if the other technically remains valid.

What Happens When the Details Don’t Match

A permit that names one employer, role, and work location doesn’t automatically cover a change to any of those three. Common situations that require an updated permit rather than continued reliance on the existing one:

  • Changing employers, even within the same industry or to a related company
  • Material changes to job duties or title, particularly where the new role wasn’t part of the original justification submitted
  • Working from a different location than the one specified, especially relevant for foreign employees who assume remote or multi-site work is automatically covered

Foreign employees who change jobs and assume their existing permit “transfers” informally, or who take on expanded duties without updating their permit’s scope, are more common sources of compliance problems than outright unauthorized work.
